End User Licence Agreement www.readyforwork.org
Your use of this service (the "Service") as accessed from the online learning portal at www.readyforwork.org is only permitted on the basis that you have read and accepted The Training Foundation Ltd ("TTF") Terms and Conditions for use as set out in this document. TTF licenses Authorised Users ("User or Users") to use the Service on the express condition that User accepts all of the Terms & Conditions in this Agreement. By Registering to use the Service, you confirm that you have both read and accept the Terms & Conditions in this Agreement. TTF and User are the only parties to this Agreement (the "Parties").
PLEASE READ THE AGREEMENT CAREFULLY BEFORE USING THE SERVICE
- 1 General
- 1.1 The Service, consisting of access to online courses, training materials and status information (the "Service") owned by TTF is provided by TTF, a Company registered in the United Kingdom, through the Service located at www.readyforwork.org (the "Site").
- 1.2 TTF agrees to provide the Service free of charge to all Authorised Registered Users and to itself meet the cost of providing the Service to Authorised Users. An Authorised Registered User is a young person who is currently in full-time education in the United Kingdom or who was until recently and is currently seeking their first employment position.
- 1.3 Any individual who does not qualify on the specified basis, but who registers on the free Service by providing false information, will be accessing the Service improperly and will be liable to a charge of £50.00 by TTF.
- Users must accept these Terms & Conditions of use before accessing the Service.
- 2 Restricted License
- Subject to the terms and conditions of this Agreement, TTF hereby grants to User a free, non-exclusive, non-transferable license to access and use the Service free of charge.
- 3 Intellectual Property Rights
- 3.1 It is hereby understood and agreed that as between TTF and User, TTF is the owner of all rights, title and interest including all Intellectual Property Rights (as defined) to the Service and the website.
- 3.2 Except as expressly provided herein, User does not acquire any rights to the Service or the website. User may not reverse engineer, decompile, disassemble, or otherwise attempt to discern the source code (i.e., the human-readable form of any computer programming code) ("Source Code") of the components of the Service, or create derivative works based thereon. User also may not download, republish, reproduce, copy, post, transmit, or in any way distribute any material from the Site unless such activities are in direct furtherance of Customer's permitted use of the Service and do not in any way violate this Agreement. Failure to comply with these restrictions will result in automatic termination of the User's right to access the Service.
- 4 Privacy and use of personal information
- 4.1 Authorised Users are required to provide contact and other personal data when registering to use the Service. This data may be provided to organisations for use solely in promoting recruitment opportunities and relevant commercial products to Authorised Users. Any use of personal data will conform to the requirements of the 1998 Data Protection Act. By confirming use of the Service in accord with the provisions of this Licence, Users agree to such organisations being provided with this information.
- 4.2 TTF will not otherwise disclose any information about the User's use of the Service in violation of the TTF Privacy Policy which is detailed in the Legal/Privacy section of www.readyforwork.org.
- 5 Term
- Users will be able to access the Service for 90 days from their date of registration. TTF may extend this at its sole discretion.
- 6 Equipment Operation
- User is solely responsible for acquiring and maintaining all computer hardware and software, telephone and communications equipment needed for access to and use of the Service.
- 7 Hyperlinked Material
- The Service content may contain hyperlinks to other sites on the Internet which are not owned or controlled by TTF. TTF cannot assume any responsibility for any material on such sites, or any other material outside of the Service web site, which is accessed directly or indirectly by any such hyperlink.
- 8 Security and Data Storage
- Although TTF has taken significant measures to ensure the security of information submitted by Users in using the Service, TTF cannot guarantee the security of information collected during such use.
- 9 Relationship of the Parties - Independent Contractors
- It is expressly understood and agreed that the relationship between the Parties is that each Party is acting as an independent contractor.
- 10 TTF WARRANTIES
- UNLESS SPECIFIED TO THE CONTRARY IN WRITING THE SERVICE IS SUPPLIED "AS IS" AND WITH ALL FAULTS. TTF MAKES AND USER RECEIVES NO WARRANTIES, EXPRESS, IMPLIED OR IN ANY COMMUNICATION. TTF EXPRESSLY DISCLAIMS IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, SECURITY, OR WARRANTY THAT OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. TTF DOES NOT WARRANT THAT THE SERVICE IS FREE OF INACCURACIES, ERRORS, BUGS, INTERRUPTIONS OR OTHER LIMITATIONS. NOR DOES TTF WARRANT THAT THE SITE, OR SERVER THAT MAKES IT AVAILABLE, IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE ENTIRE RISK ARISING FROM THE USE OR PERFORMANCE OF THE SERVICE REMAINS WITH USER WHO ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION OF PROBLEMS TO ITS EQUIPMENT CAUSED BY VIRUSES OR OTHER HARMFUL COMPONENTS.
- 11 Limitation of Liability
- User acknowledges that the operation and availability of the communications systems, including telephone service, computer networks and the Internet, used for accessing and interacting with the Service can be unpredictable and may, from time to time, interfere with or prevent access to or operation of the Service. User acknowledges that TTF is not responsible for any such interference with or prevention of User's use of or access to the Service.
- 12 Notice
- Any notice required by this Agreement or given in connection with it, shall be in writing and shall be sent via first class mail postage prepaid to the Customer's address as provided in the registration application submitted previously to TTF to The Training Foundation Ltd, at Foundation House, Millburn Hill Road, Coventry CV4 7EZ, United Kingdom.
- 13 Governing Law/Jurisdiction
- This Agreement shall be governed by and construed under the laws of England.
